Billings man Daniel Wayne Whiteman was arrested and charged with Partner Family Member Assault. On may 28, 2019 Billings Police Office Cook was dispatched by the 911 Comm Center to what dispatched described as just a disturbance in progress between a man and a woman in the parking lot of Ace Hardware located in the Heights.
A witness came up to Office Cook and stated that she saw Daniel Whiteman "shove her to the ground."
Whiteman stated to Officer Cook that the woman was his girlfriend and that she bit him. He describes to Officer Cook that both he and his girlfriend were walking and that she wanted to "go away" and that he did not want her to leave him.
Whiteman stated that he grabbed her and brought her in close and then kissed her. His girlfriend then bit him. He shoved her away from his person.
The witness who stated to Office Cook that she witnessed Whiteman pushing the woman to the ground's name is Sandra Avery from Billings.
Sandra Avery was in line for the car wash when she observed the man and woman arguing.
Sandra Avery told Officer Cook that the man moved towards the woman like he was going to hug her but then shoved her onto her back. The woman yelled at the man and appeared as if getting ready to run away until the man yelled for her to come back.
Phillip Bauer was the individual who called 911 from his cell phone. Phillip Bauer told Billings police Officer Lt Mayo that he observed a man and woman fighting while walking to the parking lot. The argument got physical, so he called the police.
After further investigation, both the victim S.B. and Daniel Wayne Whiteman are both homeless. They have been dating for about two months. The victim was using Daniel Whiteman to protect her from her ex-boyfriend, whom she stated is after her.
The argument was over the fact that Daniel Whiteman wanted to leave the parking lot, and S.B. did not want to leave. After she bit Whiteman, both Daniel and his girlfriend fell to the ground near a curb.
Whiteman stated that his girlfriend always hits him, but that he does not care.
Daniel Whiteman had two (2) Domestic Assualt and Battery in the past one back in 2011 and the other one in 2016 in the state of Oklahoma where he came from before arriving in Billings Montana.
