In other words, the prosecution must prove, beyond a reasonable doubt, each essential element of the crime charged. Until then the defendant is considered innocent of the charges

Elmer Thomas Blackbird was arrested and charged with assault.
According to the Yellowstone County Sheriff Department back on August 30, 2017, Sheriff Deputies were dispatched to the address of 5213 Shepherd Acton Road for what was described by dispatch as a disturbance in progress.
Corporal Derrek Skinner arrived first. Corporal Derrek Skinner saw 4 females outside of the home packing items into a vehicle.
The females all told Corporal Derrek Skinner that Elmer Thomas Blackbird had assaulted F.S. and D.S. and that he was still in his bedroom.
Corporal Derrek Skinner entered the home and spoke with Elmer Blackbird. Blackbird, for the most part, was very cooperative with the Sheriff Corporal.
Elmer Blackbird was bleeding from his face and was missing a chunk of hair from his head. Elmer stated to the other deputies that were present that he and F.S. were in a relationship and that they have been living together for the past six months. He stated that her daughters also lived with them in his home.
Elmer Blackbird stated that he wanted the girls to eat their chicken. After dinner two of the girls were watching television and one of them in her room.
F.S. indicated to Sgt Anthony Watson that she had gone into Elmer's bedroom and sat down near him and asked him if he was going to be upset for the rest of the evening. Elmer then slapped her in the side of the head and jumped on top of her and grabbed her neck choking her and yelling that he was going to "rip her fucking head off."
Two of the daughters heard the commotion and ran into the bedroom and jumped on Elmer to defended their mother from Elmer choking her. The daughters were able to get Elmer off of their mother and just as soon as Elmer was able to get to his feet he then hit with his fist, one of the minor girls in the head. All (4) females were able to get each other out of the house. This case had been under investigation for some time.
