Montana News Disclaimer:  One of the most sacred principles in the American criminal justice system, holding that a defendant is innocent until proven guilty. In other words, the prosecution must prove, beyond a reasonable doubt, each essential element of the crime charged.  Until then the defendant is considered innocent of the charges.

Billings mother Kristina Marie Hibbert was arrested and charged with Partner Family Assault, her first offense.  The Yellowstone County Sheriff's Office was dispatched to the address of 1920 Old Hardin Road #2 on January 5, 2019.

Kristina Marie Hibbert called 911 stating that her son was out of control.

Deputy Korth badge #3003 was the Sheriff Deputy who responded to the emergency call.

When Deputy Korth arrived, he observed a mother and a son both upset and yelling at each other in a bedroom.    Deputy Korth separated both parties from each other.

Deputy Korth then spoke to Kristina Marie Hibbert the mother, who stated to him that her son was grabbing her and hitting her.

Kristina Marie Hibbert was highly intoxicated and was having extreme mood swings Deputy Korth observed.

Hibbert's son told the Deputy that he was having severe pain in his ankle and that this all started when his mother who was high intoxicated started verbally arguing with him.

The son asked his mother multiple times to leave him alone since she was intoxicated and that made her even more upset with him.

Kristina Marie Hibbert then started to hit and shove her son.  At one point to the altercation, his mother Kristina kicked him in the ankle/shin which hurt him.

Deputy Korth was able to observe that the son was having a reduced range of motion in his ankle and that there were redness and some slight swelling.

Later during an interview, Hibbert admitted to Deputy Korth that she had kicked her son in the ankle.
