Billings man Adam Paul Walker was charged with one count of Aggravated Assault, (1) count of driving a motor vehicle under the influence of alcohol or drugs, his first offense .
on January 6, 2018 Billings police officers were called to the Billings St Vincent's Emergency Room regarding a one year old child by the initials of (S) who had a severe head injury . The child is a toddler in age.
A doctor at St Vincent's Emergency Room met with the Billings Police Officers and stated to the Officers that the child had a brain bleed and that the mother told him that, " we were helping our daughter walk when she fell over ."
Both mother and the toddler were flown to the Primary Children's Hospital were they can handle medically, traumatized children.
Sergeant Chaney from the Billings Police department spoke with the toddler's grandmother, who stated, As she was leaving the hospital she heard Adam Paul Walker comment to officers in the emergency room that he hated the "little redheaded child" and that "she was evil."
Later, Sergeant Chaney, spoke with Adam Paul Walker and he stated that he was alone with the toddler when the accident happened and that the toddler was sitting on the couch and just fell over to the left side of the couch .
Walker, claimed that he tried to set her up but that she kept just falling over. Walker, finally said he called 911 when the toddler became unresponsive. This incident occurred at home located at 3327 Rimrock Road in Billings Montana.
Detective Steve Hallam of the Billings Police department was contacted about the case. He interviewed the mother and the father. The mother indicated that the toddler was sick over the last 8 to 10 days with flu-like symptoms but that she took the child to a clinic on January 6th at about 11 in the morning.
The mother being concerned because her child from time to time kept throwing up. So according to the advise of the child Clinic doctor, she took the toddler to the emergency room to ensure nothing was wrong with her stomach so the mother took the child to the hospital around 3:40 p.m. the mother and the child arrived at the emergency room and the medical staff took an X-ray of the toddler's stomach according to the mother everything was reported fine and they were sent back home .
When Adam Walker was interviewed by Detective Hallam of the Billings Police department, Walker stated, he had an on-and-off relationship with the mother and that he really didn't like the mother anymore but it was a matter of convenience that was why he was there.
Walker confirmed to the Billings detective that he did say that he hated the little redhead. The Detective thought that was a rather odd statement in light of the type of circumstance that Adam Paul walker was dealing with.
Adam Paul Walker replied, with a nonchalant answer was, " why not be truthful." Walker stated that on January 6th the mother brought the toddler over to his house to watch for about an hour between 3 p.m. and 4 p.m. that afternoon Walker indicated that two of his own children ages six and eight were also present in the home the mother left the toddler with him for about 10 or 20 minutes .
Walker stated the toddler acted perfectly fine then.
later at some point in time, Walker's ex-wife picked up her kids.
Walker hadn't been alone with the child for more than 3 minutes before the mother of the toddler came back to the house but in those short moments the toddler was gasping for air.
The toddler was gasping for air every 15 seconds and appeared to have fast heart rate Walker described, stating the toddler "just wasn't there anymore."
At some point in time the mother came back into the house and started yelling to call 911 but at this point of the interview, Walker decided he better not talk anymore with the detective and requested to have his attorney present.
Dr. Laskey the tallest treating physician called the detective himself and gave an update on the toddlers medical condition. Dr. Laskey told Detective Hallam that the child "was in pretty bad shape" and the toddler" was suffering from subdural hematoma which was causing blood to fill to the top and to the sides of her skull." Dr. Laskey indicated that after gathering up the physical examination that was done on the toddler and other studies that were conducted including current information which was available regarding the toddler's injury the child could not possibly have had an accidental injury or a pre-existing medical condition or a reasonable discipline.
Dr. Hedlund who is an expert in Pediatric Neurology stated to Detective Hallam of the Billings Police Department that the toddler had blood in the brain and is of one age that came from one single incident according to the doctor. The toddler did not suffer any skull fracture but she did have a massive hemorrhage in both of her eyes and was breathing on her own but had to have help with oxygen and helium . furthermore the doctor continued to tell the detective that all sides of the brain were severely impacted by abuse and her visual centers with the potential of the possibility of being blind from here on out the rest of the toddler's life.
The doctor also stated that the toddler suffered Edema lack of oxygen and in many parts of her brain that would more than likely dissolve and leave large holes in the toddler's brain if the toddler were to survive the injuries sustained, the toddler would need long-term physical occupational and speech therapies .
Detective Hallam on January 16th 2018 searched the mother's phone and discovered a message from Adam Paul Walker stating, " I love you." "Devil baby LOL" "We will get past this" "Delete are texts" "Going to bed now love you both."
On January 29th Detective Holland discovered that the mother was with a Billings CPS case worker by the name of Sierra Rash and that they were discussing paperwork regarding the facts of the incident that occurred on January 6th 2018.
According to Morgan E. Drake a Yellowstone County Deputy attorney, states that Adam Paul Walker is in violation of section 45 - 5 - 202 of the Montana Code Annotated and that he is also in violation of section 61 - 8 - 401 of the MCA
