CHEYENNE,Wyo – On October 30, 2017, CPD officers responded to 612 E 2nd St. for the report of a wanted person. Officers were informed a tow company reported they were repossessing a blue Nissan Titan pickup registered to 32-year-old Daniel Gutierrez.
Gutierrez was found to have a felony federal warrant for probation violation with an original charge of felony possession of amphetamines and was listed as armed and dangerous.
As officers approached the house they observed the blue Nissan Titan pickup belonging to Gutierrez parked at the end of the driveway. Officer Casey Patterson went around the house into the backyard to cover the back door and prevent escape while another officer knocked on the front door in an attempt to serve the arrest warrant on Gutierrez.
Ashley Gutierrez, 28-year-old female, came out of the residence into the backyard to confront Officer Patterson. While Ashley was arguing with Officer Patterson, a large 120-pound dog ran out from the house behind Ashley toward Officer Patterson. Ashley told Officer Patterson, “He will get you,” at which time the dog attacked Officer Patterson by biting him on the left forearm and wrist.
The dog eventually let go, repositioned and lunged again at Officer Patterson. Officer Patterson then fired his duty pistol at the dog, continuing to fire until the dog stopped coming after him, firing a total of 5 shots.
The dog died on scene and was recovered by Cheyenne Animal Control Officers. Officers were unable to locate Daniel Gutierrez who is still at large and wanted by the United States Marshals, and is still considered Armed and Dangerous.
Gutierrez is a white male, 5’7” tall, with brown hair and brown eyes. He has large tattoos on his neck and head. If his whereabouts are known please contact the Cheyenne Police Department at (307)637-6524.
