Billings man Robert Henry Turner, was arrested and charged for the operation of a vehicle and resisting arrest, obstructing a peace officer, and driving while his license was suspended and having no proof of insurance.
According to a court hearing Deputy Harrison Gillen was on patrol on the old Hardin road when he observed gold SUV approaching him in the westbound lane. The SUV was traveling faster that the posted speed limit according to Deputy Harrison Gillen.
Upon the traffic stop, Deputy Gillen noticed that the driver and the passenger were acting very nervous and both smelled of alcohol.
The driver of the vehicle did not have any of the documents that Deputy Gillen asked for such as proof of insurance and registration of the vehicle.
As Deputy Gillen was in his patrol car running a NCIC on the driver and his passenger, Billings man Robert Henry Turner stepped out t of his gold SUV and approached Deputy Gillen who was sitting in his vehicle.
Deputy Gillen notice that Robert Turner was having some difficulty walking and that he smelled of alcohol. As Deputy Gillen was running the records check, it was discovered that the driver Robert Turner had a suspended license and also had an active warrant for his arrest that was issued out of the Billings Police Department.
In the beginning of the conversation with the defendant, Robert Turner, Turner was cooperative with Deputy Gillen, but suddenly Turner became angry and belligerent acting, lit a cigarette.
When Deputy Gillen asked for Turner to put out the cigarette, Turner refused to comply and became very aggressive towards Deputy Gillen, causing Deputy Gillen to pull out his taser and verbally order Turner to turn around, Turner, said to the Deputy, "No...Fuck...No."
Deputy Gillen then deployed his taser striking Turner, but Turner did not respond to the taser and Deputy Gillen retreated to keep his patrol car between himself and Turner until he could reload his taser. At this point and time Turner fired off another taser pod striking Turner again.
This time Turner fell to the ground face first. Several people were standing watching as they stepped in to help Deputy Turner and assist him.
Robert Henry Turner has a long criminal history with three (3) prior arrests for DUI. They are as follows: 02/21/2008, 10/20/2007 and 05/22/2010
When Turner was being booked into the county jail, he did admit to the fact that he had drank a whole bottle of Vodka prior to his arrest that day.
