Here is what happened on March 18, 2017 regarding a report of two people having been shot on the 2300 block of Ave C. The Billings 911 Comm Center dispatch, received at least (3 or 4) calls regarding a possible multiple shooting. Billings Police Officer Freeman was the first responding officer that arrived on the scene.
As Officer Freeman got to the scene of the crime, at least 3 people flagged down Billings Officer Freeman. A black Avalanche pickup was parked partially on the sidewalk and partially on the curb.
The accused, Harold Joseph Smith, was kneeling by the one of the shooting victim’s K. D. who lay lying on the ground.
Harold Smith was trying to assist K. D. from bleeding further as Officer Freeman arrived on the scene. Harold Smith was trying to stop K.D.’s from bleeding out, according to a witness who spoke to the Montana News who asked not to be identified.
According to Officer Freeman’s police report, Harold Smith indicated that he had shot K. D. in self defense and that the gun that he had used was in his pocket. Officer Freeman seized Harold Smith’s gun and secured the gun. Later it was determined that at least 5 spent casings had been fired from that very gun.
K. D. is the husband of Alicia Davis.
Kellie Davis was losing color and his lips were already turning bluish. K. D. was suffering from multiple shots. One shot to the neck, one shot in his back and one shot in his butt.
Lying near Kellie Davis was yet another man who had also been shot. This man was about 12 feet away from where Kellie Davis was lying on the ground. The second gunshot victim goes by the initials of A.S.
According to the Billings Fire Department, a male firefighter who was on the scene, located a bullet in K. D’s neck and removed it. Both of the shooting victims were taken to the emergency room at the hospital. It appears that Smith was trying to render aid to one of the men that he shot.
The Billings Police report to the press, only stated only this:
“On 3/18/17 at 1808 hrs., Billings Police responded to a shoot at this location. Upon arrival police located two males that had been shot. One male was shot once (non-life-threatening) and the other male had been shot multiple times (Life Threatening) after a verbal disturbance. Both individuals were transported to St Vincent’s Hospital. A suspect was detained at the scene and after further investigation was charged with two counts of Felony Assault and remanded in the Yellowstone County Detention Center.”
