Missoula Man David Lee Kennedy Jr., was arrested and charged with driving under the Influence of Alcohol or Drugs (4)th Offense; Fleeing from or Eluding a Peace Officer; Reckless Driving; Driving While License Suspended or Revoked; Obstructing a Peace Officer and Driving after Dark W/O Lamps Lit.
Facts and allegations surrounding the charges:
On October 31st 2016, at approximately 11:45 p.m. A Missoula City Police Officer by the name of Sergeant Denton was on patrol when he observed a vehicle traveling west bound on Cooley St with no lights on.
The vehicle was a Dodge Stratus. According to Police notes and report, the suspect vehicle turned left on Burns Street and then into an alley. As the vehicle was trying to elude the officer the Dodge Stratus struck a fence and came to a stop.
Sergeant Denton activated his patrol cars lights and siren and attempted to come on the scene of the crash. The driver of the vehicle was David Kennedy. Sergeant Denton recognized this individual due to past dealings with this man.
During David Kennedy Jr eluding the Officer, David Kennedy drove his vehicle across someone’s private lawn and then turned down Russell Street where his tire blew out. Kennedy lost control of his vehicle momentarily and the swerved into the on-coming lane of traffic.
During the chase David Kennedy Jr., never exceeded 45 miles per hour. Sparks started to fly from the metal rim of the flat tire grinding on the pavement. In the area of Commerce Street and Railroad Street. David Kennedy Jr., lost control of his vehicle and he drove up an embankment.
Once he regained control of the vehicle he then crashed his vehicle into a metal fence post near Railroad Street and Market Street.
This was where Sergeant Denton was able to apprehend David Kennedy Jr., Not only was he drunk Kennedy Jr., had a strong odor of burnt marijuana coming off of his person.
Jail Staff noticed that David Kennedy Jr., had wounds on his arm that was consistent with intravenous drug use.
